Introduction

Delay in construction schedules has now become almost an epidemic in construction projects. The user loses the use of the facility and applies liquidated damages against the contractor, who then claims that such delay is due to the employer claiming for damage compensation and requesting time extensions. Any Time Extension Request must stand entirely on its own merit, be well analyzed and emphasized, properly documented, and fully substantiated so that there is no question about the validity of the request.

Objectives

This 5-day course will provide in-depth understanding of the concepts and art of preparing and defending Time Extension Requests. It will also present a base understanding of scheduling techniques used in delay analysis. The course covers the basic concepts of delay, tracking delays, mitigating delays, the baseline schedule, as well as analyzing the effect of delay on the baseline schedule. In addition, it gives a detailed guide to preparing a comprehensive Extension of Time Request, including the prolongation and disruption costs.

Categories and Types of Delays, Delay Causes, Reviewing Fundamental Causes of Delay, Time of Its Occurrence & Who Caused It; Which Delays Add to the Difficulty of the analysis. Techniques for Proving Delay with CPM, Concurrent Delays, Acceleration/Job Compression, Checklist for Use of CPM in Litigation, Delay Claims; Cost Estimation for Delays – Scheduling Provisions, Emphasis on Network Analysis Techniques, Job Acceleration/Compression, Disruption Claims, Relationship Between Loss & Expense & Extensions of Time; Case Study.

Day Three

Damages for Delay in Construction Projects – Whether to Liquidate or Leave Damages Unliquidated, Assessment and Proof of Damages for Delay, Relative Merits of Liquidated vs. Unliquidated Damages, CPM method and the Relevant Software, The ability to Tie the Schedule’s Activities by Logic Relationship; As-Planned vs. As-Built Method, Impact As- Planned Method, Collapsed As-Built Method, As-Built Method, Windows Analysis Method, Case Study.
